Terms & Conditions

These Terms & Conditions ("T&Cs") govern the services provided by Luke O’Shea Phillips Photography (the "Photographer," "we," "us," or "our") to clients ("you," "your"). By booking a photography session or purchasing prints from our website, you agree to these terms.


2. Booking & Payments

2.1 Booking Confirmation

  • A booking is confirmed once both parties agree on the date, time, and scope of work in writing (email confirmation is sufficient).

2.2 Payment Terms

  • Full payment is required within 14 days of the invoice date, unless otherwise agreed.
  • Late payments may be subject to a 5% late fee per week.

2.3 Cancellation & Rescheduling

  • Client Cancellation:
  • More than 7 days before the shoot – no charge.
  • Less than 7 days before the shoot – 50% of the agreed fee is payable.
  • Less than 48 hours before – full fee is payable.
  • Rescheduling: One reschedule is allowed if requested at least 72 hours before the shoot.

2.4 Licensing & Copyright Transfer Fees

  • If the Client requires full copyright ownership, an additional fee of £100 per day of shooting applies.
  • If copyright is transferred, the Photographer retains the right to use images for portfolio, self-promotion, and industry recognition, unless otherwise agreed.
  • If no full copyright transfer is requested, the Client will receive a commercial usage license allowing for unlimited internal and external corporate use.


3. Deliverables & Editing

3.1 Image Delivery

  • Delivery timeframe: High-resolution digital files will be delivered within 7-14 business days unless otherwise agreed.
  • File format: Images will be provided in JPEG, TIFF, or RAW (if agreed in advance).
  • Storage: Files will be stored for 3 months. After this period, retrieval may incur an additional charge.

3.2 Editing & Retouching

  • Standard colour correction is included in all photography packages.
  • Additional client-requested editing is billed at £100 per hour.


4. Copyright & Image Usage for Corporate Clients

4.1 Copyright Transfer (If Requested by Client)

  • If full copyright is purchased, the Client will receive all rights to the images, including commercial resale and distribution.
  • Copyright transfer is not included in standard photography packages and must be requested in writing.
  • Once transferred, the Photographer waives all future claims to licensing fees but retains the right to use images for portfolio and promotional purposes unless otherwise agreed.


4.2 Standard Commercial Usage Rights (If Copyright is Not Purchased)

  • By default, Clients receive a commercial usage license, allowing unlimited internal use (website, social media, print, marketing).
  • The Client cannot resell or transfer the images to third parties (e.g., stock agencies) without additional licensing.



5. Travel & Expenses

  • Travel outside of London is charged at £0.45 per mile.
  • Parking, tolls, congestion charges, and accommodation (if required) will be invoiced at cost.



6. Liability & Indemnity

  • The Photographer is not responsible for loss of images due to unforeseen circumstances (e.g., technical failure, theft).
  • In the event of equipment failure or image loss, liability is limited to a full refund or a reshoot at no additional cost.



7. Refunds & Revisions

  • Refunds are not available once images have been delivered.
  • If there are concerns with the final images, one round of minor revisions is included (colour corrections, minor adjustments). Further revisions are billed at £100 per hour.



8. Privacy & Data Protection

  • Client data is stored securely and used solely for business communication and record-keeping.
  • We do not share client data with third parties without consent.



9. Governing Law

These Terms & Conditions are governed by UK law, and any disputes will be handled in UK courts.
